By accessing or using WarmEvents, whether via our website or mobile applications (collectively, the 'Platform'), you agree to be bound by these Terms of Use and our Privacy Policy.
WarmEvents is a technology platform that connects individuals planning special occasions ('Customers') with independent service providers such as photographers, bakers, entertainers, chefs, and event planners ('Vendors').
WarmEvents does not directly provide or supervise any of the services listed on the platform. All services are provided by independent Vendors. WarmEvents does not endorse, guarantee, or assume responsibility for any Vendor or their services.
You may use our Platform to search for, book, or offer event-related services. Vendors must provide accurate listings and comply with local laws.
The WarmEvents mobile app is available for download via the Google Play Store. By using the mobile app, you agree that its functionality is subject to device limitations, platform-specific rules, and applicable app store policies. Some features may differ or be limited compared to the web version. We do not guarantee full feature parity across platforms.
You may manage permissions and data collection through your mobile device settings. Disabling required permissions may affect app functionality.
Our mobile application complies with applicable Google Play Developer Policies.
4.1 Account Creation
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register for a WarmEvents account.
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and are liable for all activity under your account.
4.3 User Conduct
You agree to use the Services only for lawful purposes and not in a way that violates any law or the rights of others.
5.1 Independent Contractors
Vendors on WarmEvents are independent contractors and not employees, agents, or representatives of WarmEvents.
5.2 No Agency Relationship
These Terms do not create any employment, agency, joint venture, or partnership relationship between WarmEvents and any Vendor.
5.3 Disputesghjc
Disputes arising between Customers and Vendors must be resolved directly. WarmEvents does not mediate such disputes.
Vendors agree to honor bookings, maintain quality standards, and communicate promptly with customers. Fees and subscription models will be detailed in the vendor dashboard.
Vendors are solely responsible for compliance with applicable laws and regulations governing their services.
7.1 Charges
Customers may be charged fees including service costs, taxes, or additional charges when engaging Vendors.
7.2 Payment Processing
WarmEvents uses third-party providers (e.g., Stripe) to process payments and acts as a limited collection agent. Disputes related to payment processing may be governed by the third-party provider’s terms of service.
7.3 No Refunds
All charges are final unless otherwise required by law or WarmEvents’ discretion.
8.1 Vendor Responsibility
Vendors are responsible for performing services safely and professionally. WarmEvents is not liable for damage caused by Vendors.
8.2 Limitation of WarmEvents Liability
WarmEvents is not liable for personal or property damage caused by Vendors’ services.
All content on the Platform, including text, images, logos, videos, and software, is the property of WarmEvents, LLC or its licensors and is protected by copyright and other intellectual property laws.
Users may submit reviews, comments, or other content through the Platform. You grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute this content.
You agree not to post false, misleading, or incentivized reviews. We reserve the right to moderate, remove, or refuse content that violates these Terms or our Community Guidelines.
WarmEvents may suspend or terminate your access to the Platform at any time for violations of these Terms or applicable law.
You may terminate your account at any time by following account settings instructions.
WarmEvents provides the Platform 'as-is' and does not guarantee uninterrupted or error-free access. We disclaim all warranties to the fullest extent permitted by law.
WarmEvents is not responsible for any damages arising from your use or inability to use the Platform, including mobile app-specific issues or third-party service failures.
WarmEvents’ total liability to you shall not exceed the greater of (a) the amount paid by you in the last 12 months, or (b) $500.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
Parties agree to attempt to resolve disputes through good-faith negotiations before resorting to litigation. Any disputes shall be resolved in the courts located within Massachusetts.
